Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This anticipatory bail application has been filed by the applicant-Babu Khan in Criminal Case No. 1226 of 2021, Case Crime No. 438 of 1999, under sections 420, 467 & 468 IPC I.P.C., P.S.- Civil Lines, District - Aligarh.
Learned counsel for the informant referred to the orders annexed at page 104 of the anticipatory bail application which shows that the Application u/s 482 Cr.P.C. was disposed of with a direction to the applicants to appear before the court below within 15 days and give bail application. It was also directed that if such bail application is given the same shall be heard expeditiously and preferably on the same day and shall be disposed of in accordance with law. For that 15 days it was directed that no coercive action shall be taken against the applicants.
Learned counsel for the applicant has made a request that he does not want to press this anticipatory bail application and the simple requests that a direction may be issued to the court below to consider the bail application when given on the same day and the application for anticipatory bail may be rejected.
In view of the request made above, Anticipatory Bail Application is rejected as not pressed.
A direction is however given to the court below that in case applicant surrenders and gives regular bail application within 15 days from today, the same shall be disposed of expeditiously and preferably on the same day in accordance with law.
