The FIR in Crime No.831/2014 of the Kannur Town Police Station, registered under Section 420 of the Indian Penal Code is sought to be quashed under Section 482 of the Code of Criminal Procedure on the ground that the accused and the complainant have come to terms amicably out of court.
The learned Public Prosecutor submits that the police has already submitted final report in 19.7.2014. If so, the petitioner will have to approach the trial court for composition under Section 320 of the Code of Criminal Procedure. The offence under Section 420 of the Indian Penal Code is compoundable.
With this observation, this Criminal Miscellaneous Case is closed.
