Order:
This Writ Petition is filed for the following substantive relief:
“to issue a Writ of Mandamus or any other appropriate Writ, Order or Orders, Direction or Directions to the Respondents to act in accordance with law by not insisting the Petitioner to do the business of wholesale dealer in Fertilizers pursuant to the license issued to it by the 4th Respondent in the District of East Godavari only under the Provisions of Fertilizer (Control) Order, 1985 and to issue a consequential direction to the Respondents not to interfere with the business of the Petitioner as wholesale dealer in Fertilizers by insisting it to do its business in the District of East Godavari only.”
At the hearing, it is not disputed by the learned Counsel for both the parties that the issue similar to that raised in this Writ Petition viz., whether the petitioner, which is a wholesale dealer, can be restrained from selling the fertilizers from its authorized sale depot to persons belonging to the Districts other than the one, in which it holds license, was decided by this C o u r t vide W.P.No.33768 of 2012, dated 30.10.2012.
For the same reasons as contained in the aforesaid order, this Writ Petition is disposed of with the direction that the reasons and directions contained therein shall form part of this order.
As a sequel, WPMP.No.45760 of 2014, filed by the petitioner for interim relief, is disposed of.
