Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that the applicant was on bail in the present case. He could not appear due to illness before the trial Court, hence bail was cancelled and warrant was issued. The prayer for bail was rejected by the trial Court. Now he is in jail since 20.5.2010. The applicant will not misuse the liberty of bail and will co-operate with trial, if he is released on bail.
In this view of the matter, without expressing any opinion on merits of the case, let the applicant namely, Babloo Singh @ Shushil Singh be released on bail in Case Crime No. 56/2005, S.T.No. 343/06, under sections 147, 323/149, 308/149, 452 and 506 I.P.C., P.S.
