Heard learned counsel for the appellant, learned counsel for the opposite party no.2 as well as learned A.G.A.
By means of the present appeal, the prayer sought by the appellant is to set-aside the order dated 16.07.2019 passed by learned Special Judge, SC/ST Act, Sant Kabir Nagar in Bail Application No.709 of 2019, Babloo@Habiburrahman Vs. State of U.P. arising out of case crime no.357 of 2019 under sections 147, 323, 504, 506, 354B, 406, 420 IPC and Section 3(1)(w)(1) and 3(1)(da)(dha) of SC/ST Act, Police Station-Khalilabad, District-Sant Kabir Nagar.
Pursuant to the earlier order dated 10.12.2019, cross cheque of SBI bearing no.602205 for the amount of Rs.four lacs dated 13.12.2019 has been handed over to learned counsel for the opposite party no.2 to the satisfaction of his client. Now, opposite party no.2 is no more interested to pursue the matter against the appellant any more.
Accordingly, the present criminal appeal stands allowed and the impugned order dated 16.07.2019 passed by learned Special Judge, SC/ST Act, Sant Kabir Nagar against the appellant is hereby set-aside.
