Heard Mr. Gaurav Kakkar the learned counsel for the applicants and Mr. Amitabh Agrawal the learned counsel for the respondent no.2 and the learned A.G.A for the State.
Learned counsel for the applicants has submitted that the present matter is a matrimonial matter and the said matter can be well considered by the Mediation Centre of this Court.
After having and gone through the entire facts and circumstances on record in the light of the contention of the learned counsel for the petitioner, I do find it expedient that the parties should be given an opportunity to arrive on a compromise, therefore, it is directed that the applicants shall deposit a sum of Rs. 10,000/- within one month from today with the Mediation Centre of which 75% shall be paid to the private opposite party for appearance before the Mediation Centre.
The matter is hereby remitted to the Mediation Centre of this Court with the direction that the same may be decided after giving notice to both the parties.
It is directed that the Mediation Centre shall decide the matter expeditiously, preferably within a period of two months. Thereafter, the case shall be listed before the appropriate Bench on 30th August, 2010.
Till the next date of listing, further proceedings of Case Crime No. 87 of 2010 u/s 498A IPC and section 3/4 of the Dowry Prohibition Act, P.S. Jahangirpuri, District Gautam Budh Nagar as well as entire proceeding of case no. 2650 of 2010 pending in the Court of IInd Additional Chief Judicial Magistrate, Gautam Budh Nagar shall be kept in abeyance. After depositing the aforesaid amount, notice shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, the interim protection granted above shall automatically stand vacated.
