Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the impugned order dated 05.05.2018, by which N.B.W. issued by learned Additional Session/Special Session Judge, SC/ST Act, Siddharth Nagar against the applicant in Special Session Trial No.009 of 2016, (State Vs. Poosu @ Arvind Kumar and others), arising out of Case Crime no.567/2015, under Sections 147, 323, 504, 506 I.P.C. & 3(1)X SC/ST Act, P.S. Khesraha, District Siddharth Nagar.
After hearing learned counsel for the parties and after perusing the averments made in the present application, filed under Section 482 Cr.P.C., no case for any interference has been made out. Accordingly, the prayer, as made above, is refused.
However, without expressing any opinion on the merits of the case, it is directed that in case the applicant appear and surrender before the courts below and apply for bail, his prayer for bail shall be considered and decided expeditiously in accordance with law.
For a period of one week, no coercive action will be taken against the applicant.
With the aforesaid direction, the instant application, filed u/s 482 Cr.P.C. is disposed of finally.
