1. Rule.
Ms.Tejal Vashi, learned advocate appearing for Mr.Jal Unwala, learned advocate, waives service of notice of Rule on behalf of the contesting respondents.
2. The present Civil Application has been preferred by the applicants herein
- original appellants - original defendant Nos.2, 5 and 6 for appropriate interim order to stay the implementation, execution and operation of the impugned judgement and order dated 30/10/2010 passed by learned Additional District Judge and Presiding Officer, First FTC, Valsad in Regular Civil Appeal No.104 of 2002.
3. Having heard learned advocates appearing on behalf of the respective parties and when the main Second Appeal is already admitted and with a view to see that the Second Appeal does not become infructuous, by way of interim relief further implementation, execution and operation of the judgement and order dated 30/10/2010 passed by learned Additional District Judge and Presiding Officer, First FTC, Valsad in Regular Civil Appeal No.104 of 2002 is hereby stayed. In the facts and circumstances of the case, it will be open for the contesting respondents to submit an appropriate application for fixing early date of hearing after the paper- book is supplied but the same shall not be before 30/06/2013. Rule is made absolute to the aforesaid extent. No costs.
