The applicants have questioned the correctness of the findings returned in the order dated 05.09.2019 passed by the Special Court, S.C./ S.T. Act,/ Additional Sessions Judge, Hathras, convicting the appellant and awardinghim sentence.
It is submitted by learned counsel for the appellant that the appellant was on bail during bail.
Considering the facts and circumstances of the case, let the appellant, namely, Babbu convicted and sentenced in ST No. 307 of 2011 in Case Crime No. 721 of 2010 under Sections 363,376 IPC and Section 3(1)(12) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, P.S.- Ajeemnagar, District- Rampur be released on bail on furnishing his person bonds and two sureties each of the like amount to the satisfaction of the court concerned.
The sentence and penalty awarded under the order dated 05.09.2019 shall remain stayed during the pendency of this appeal.
