Ref: Order on Criminal Misc. (Modification) Application No.4 of 2019 Heard Sri Rahul Kumar Tiwari holding brief of Sri Surendra Kumar Tripathi, learned counsel for the appellant and Sri Gaurav Pratap Singh, learned AGA for the State.
Sri Rohit Shukla, learned counsel for the complainant is not present though a copy of the modification application has been served upon him on 30.07.2019, as it appears from the application itself.
Learned counsel for the applicants submitted that on 07.05.2019 this Court has granted bail to the applicants with a direction that they shall be released on bail on their furnishing personal bonds with two heavy sureties (out of which one should be a family member) but they are not able to furnish the same, on account of which they could not be released on bail, hence, the said order may be modified.
In view of the above, the order dated 07.05.2019 is modified to the extent that the applicants shall be released on bail on their furnishing a personal bond of Rs. 1 lac along with two sureties out of which one should be of his close relative.
Accordingly, the present modification application stands
allowed.
