Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1, 3 & 5 and Sri B.L. Yadav, learned counsel for respondent nos.2 and 4.
The petitioner has been appointed as Assistant Teacher in Higher Primary School, Khurrampur, Muzaffarrabad, Saharanpur by appointment letter dated 21.09.2015. Pursuant to the said appointment letter, petitioner has joined the institution and has been continuously working since then. The salary of the petitioner has been stopped since July, 2017.
The grievance of the petitioner is that she has been denied salary illegally without rhyme and reason and she, in this regard, has submitted representations to respondent no.4- District Basic Education Officer, Saharanpur, copy of which is annexed as Annexure 7 to the writ petition.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction be issued to respondent no.4 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.4-District Basic Education Officer, Saharanpur, raising all her grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.4 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.
With the aforesaid observations, the writ petition is disposed of.
