Heard learned counsel for the petitioner and Shri Amit Kumar Srivastava, learned State Law Officer.
In view of the order proposed to be passed, notices need not go to private respondent.
The petitioner is before this Court for a direction to second respondent to decide Mutation Case No.T201705205523394 (Babita Devi v. Ramsakhi) under Section 34 of LR Act within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to second respondent to consider and decide the aforesaid mutation case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
