1.0 By way of present petition, the petitioners have challenged the order dated 16.08.1997 passed by respondent No.1 determining the number of posts available to the common clerical cadre and the common accounts cadre in the Banaskantha District Panchayat and the posting of the existing junior clerk on the posts so determined.
2.0 In view of the fact that order dated 16.08.1997 which is challenged in the present petition has already been quashed and set aside by the Additional Development Commissioner at Gandhinagar vide order dated 01.04.1998 in Appeal No. 22 of 1998 and as the said decision is accepted by the respondent by not challenging the same, there is no question to quash and set aside the order which is challenged in the present petition. In that view of the matter, the petition stands disposed of accordingly. Subject to above, Rule is discharged with no order as to costs.
