The above appeal is directed, against an order dated 29.7.2006 in OP No.599/05 of the Family court, Ernakulam, at the instance of the respondent therein, since by the impugned judgement, the Family court allowed the petitions filed by the respondent herein declaring that the property scheduled to the above O.P. and accommodated by Ext.A1 title deed is actually that of the respondent herein and he is the exclusive title holder of the said property. He is also granted an order of permanent prohibitory injunction restraining the appellant herein from alienating or encumbering the said property. The above appeal was filed on 20.11.2006. This Court, by giving two weeks' notice in advance, had posted the matter today for hearing. The counsel appearing for the respondent submitted that the Mat.Appeal No.347 of 2006 2 matter has been settled out of court. The learned counsel appearing for the appellant submitted that though a letter was sent to the appellant herein, there is no response from her side and the learned counsel seeks time. The above submission of the learned counsel for the appellant as well as the respondent are recorded. In view of the submission made by the learned counsel for the appellant, it is crystal clear that in spite of the letter sent from the concerned counsel, the appellant has not responded, which itself shows that she is not interested in prosecuting the appeal.
In the result, the above appeal stands dismissed for non prosecution.
