JUDGMENT / ORDER

1. Heard Mr. Pahwa, learned advocate for the petitioner.
2. In view of the tenure of the order passed by the learned Appellate Tribunal, which is brought under challenge in present petition, on earlier occasion at the time of hearing of petition, it was observed that before the petition can be entertained, the petitioner should move appropriate application before the learned Appellate Tribunal in connection with the order dated 28.12.2011 passed by the learned Appellate Tribunal, particularly in light of the contentions which are sought to be raised by the petitioner in present petition.
3. It appears that in view of the said observations, the petitioner herein has moved an application to the said effect before the learned Appellate Tribunal and the said application is pending for hearing. Learned advocate for the petitioner has submitted that further hearing of the said application is now scheduled to take place on 6.6.2012. Therefore present petition is disposed of at this stage with a liberty to the petitioner to file appropriate application to revive present petition if the said application is decided against the petitioner. At that time, while placing order passed by the learned Appellate Tribunal on record the petitioner may request for revive of present petition.
With the aforesaid clarification the petition is dispose of accordingly.
