1. RULE.
Ms. Sejal K. Mandavia, learned advocate for the opponent Board waives service of Rule for the opponent. With consent of the parties, the application is taken up for final hearing forthwith.
2. Heard Mr. I.S. Supehia, learned advocate for the applicant - original petitioner and Ms. Sejal K. Mandavia, learned advocate for the opponent Board.
3. Considering the averments made in the application and more particularly that the issue is covered by earlier judgment passed by this Court in Special Civil Application No.11923 of 2008 and allied matters as well as confirmed in the Letters Patent Appeal, the main matter being Special Civil Application No.30536 of 2007 is fixed for final hearing in the week beginning from 5.3.2011 along with two other cognate matters being Special Civil Application Nos.30541 of 2007 and 30539 of 2007.
4. Rule is made absolute to the aforesaid extent.
