ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.5 in admitting third parties as members during his tenure as person-in- charge of respondent No.4-society as illegal and arbitrary.
I have heard Sri A.Purushotam Reddy, learned counsel for the petitioners and perused the record.
For more reasons than one, the Writ Petition is wholly misconceived. First, the petitioners have not filed the purported proceedings under which respondent No.5 has admitted as many as 450 persons as members of respondent No.4-society, second, as the petitioners have not impleaded the persons who are allegedly admitted as members, no order prejudicial to their interests can be passed behind their back and third, the alleged admission has taken place as far back as the year 2005 and the petitioners have not raised a whisper as to the reason for their not questioning the said admission for as long as nine years. The Writ Petition, therefore, suffers from uncondonable laches.
For all the above-mentioned reasons, the Writ Petition is wholly without merit and the same is, accordingly, dismissed.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.37374 of 2014 filed by the petitioners for interim relief stands disposed of as infructuous.
