Karthick ..Respondents Prayer: This Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to call for the records relating to the FIR No.986 of 2017 set to be dated 04.06.2017 received in Court at 22.15 hours on 05.06.2017 on the file of 13th Metropolitan Magistrate, Allikulam, now transfer to Juvenile Justice Court at Kellys, Purasawalkkam, Chennai.
For Petitioners : Mr.K.Chaiman Selvaraj For 1st Respondent : Mr.M.Mohamed Riyaz Additional Public Prosecutor O R D E R This petition has been filed seeking to call for the records and quash the criminal proceedings initiated by the respondent in Crime No.986 of 2017, dated 04.06.2017.
2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the respondent Police.
3. The contentions put forward by the learned counsel appearing on behalf of the petitioners are purely factual in nature and this Court cannot venture into conducting a mini investigation into the matter and it therefore does not fall within the ambit of its jurisdiction under Section 482 of Cr.P.C. Any finding on facts will also have a bearing on the investigation conducted by the respondent Police.
4. In the facts and circumstances of the case, this Court is not inclined to interfere with the investigation conducted by the respondent Police at this stage.
5. Taking into consideration the facts and circumstances of the case, there shall be a direction to the respondent Police to complete the investigation and file a final report or a closure report, as the case may be, within a period of four weeks from the date of receipt of a copy of this order.
This Criminal Original Petition is disposed of with the above direction.
