… Respondents THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.21271 OF 2014 O R D E R The petitioner is aggrieved by the insistence of the registration authorities that he has to produce a ‘no objection certificate’ from the revenue authorities for registration of his land in Sy.No.18/45/A of Bendere Village, Wankhidi Mandal, Adilabad District.
The issue is squarely covered by the judgment dated 01.10.2013 of a learned Division Bench of this Court in Writ Appeal No.1653 of 2013. By the said judgment, the Division Bench confirmed the judgment of the learned Single Judge to the effect that demand for production of a ‘no objection certificate’ was nothing but an arbitrary action and directed that a ‘no objection certificate’ shall not be demanded unless authorized by an appropriate enactment with prospective effect.
In that view of the matter, the writ petition is disposed of directing the Sub-Registrar, Asifabad, Adilabad District, not to insist upon production of a ‘no objection certificate’ from the revenue authorities in respect of the subject land for entertaining any document presented by the petitioner for registration. WPMP No.26686 of 2014 is closed in the light of this final order. No order as to costs.
