ORDER:
Heard.
2. Learned government pleader has received instructions which say that the lands, in question, are Gairan Sarkari as per Khasra pahani and that the assignees, to whom it was assigned, alienated the said lands through registered sale deeds. However, no notice appears to have been issued to the petitioners, who are stated to be in possession.
3. In view of that, on 25.07.2014, while granting stay of dispossession, it was left open for respondent No.4 to issue notice and hear the petitioners before taking any action.
4. Since the issue involved in the writ petition only relates to complaint of the petitioners that they are being dispossessed without following due process of law, the writ petition is disposed of in terms of the earlier interim order, dated 25.07.2014, and respondent No.4 is directed that if he desires to take any action against the petitioners, he shall given due notice, hear them and then pass appropriate orders and shall not dispossess the petitioners without following the aforesaid course of action.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
