This Transfer Criminal Petition is filed to direct IX Special Magistrate, Hyderarbad at Erramanzil to try CC.No. 481 of 2011 alongwith CC.Nos. 441, 443 and 448 of 2011 on the file of VII Special Magistrate, Hyderabad, CC.No. 250 of 2011 on the file of XIII Special Magistrate, Hyderabad and CC.No. 478 of 2011 on the file of IX Special Magistrate, Hyderabad, by transferring all the cases to one Special Magistrate Court, Hyderabad.
2. The petitioner has already approached Metropolitan Sessions Judge, Hyderabad for the same relief and the learned Metropolitan Sessions Judge after considering contentions of both parties held that there are no valid grounds to transfer all the cases to one court since the complainants are different and all the criminal courts are in one complex. On 25/2/2014 there was no representation on behalf of petitioner either in the morning or in the afternoon and the matter was directed to be listed under the caption for dismissal on 04/3/2014. Again when the matter was listed on 07/3/2014 there was no representation and no interest is evinced and on account of pendency of this petition, trial of old case of 2011 for an offence under section 138 of Negotiable Instruments Act is held up.
3. Considering these aspects, I am of the view that there are no merits in the application and petition is liable to be dismissed.
4. Accordingly, Criminal Petition is dismissed.
