This contempt case was instituted alleging willful disobedience to the order dated 31.10.2012 passed by this Court in W.P.M.P. No.43178 of 2012 in W.P. No.33941 of 2012. By the said order, the Kothagudem Thermal Power Station, Paloncha, Khammam District, was directed to consider the cases of the petitioners for engagement as Contract/Casual Labour in the O & M Works of Kothagudem Thermal Power Station, Stage-V, Paloncha, on a preferential basis in the event they engage Contract/Casual Labour for such works.
2. It is now admitted that the petitioners have been duly engaged as per the above order. Further the Chief Engineer (O & M), KTPS, V & VI Stages, TGENCO, Paloncha, Khammam District, filed an additional affidavit stating categorically that the petitioners would be engaged in terms of the aforestated order of this Court in preference to other contractors. This undertaking was given without prejudice to the right of the respondents to seek modification/clarification of the order.
3. In the light of the aforestated undertaking, this Court is of the opinion that no cause is made out for exercise of contempt jurisdiction in the matter presently. Needless to state, in the event the respondents fail to implement the order despite the above undertaking, it would always be open to the petitioners to approach this Court once again.
4. The contempt case is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed in consequence. There shall be no order as to costs.
