Ramalingam, Advocate for R1) This criminal revision petition filed under Section 397 of Cr.P.C. praying to set aside the judgment and sentence passed by the XX Additional Chief Metropolitan Magistrate and XXII Additional Small Causes Judge, Bengaluru in C.C. No.27465/2001 vide order dated 28.07.2007 This criminal revision petition coming on for Admission this day, the Court made the following:
ORDER Both the counsel for petitioner and respondent have filed joint compromise application under Section 147 of Negotiable Instruments Act. Both the petitioner and respondent are present and are admitted that they settled their disputes amicably. Hence the compromise is accepted.
In view of the compromise, criminal revision petition is allowed.
The judgment of conviction and sentence dated 28.07.20107 passed by XX Additional Chief Metropolitan Magistrate in C.C. No.27465/2001 and Criminal Appeal Nos. 990/2007 and 1006/2007 are hereby set aside, and the petition is argued for the charges under Section 138 of Negotiable Instruments Act.
The petitioner is permitted to withdraw the fine amount of Rs.1,80,000/- (Rupees One Lakh Eighty Thousand Only) with accrued interest, deposited by the trial Court in Bank.
Hence the criminal revision petition is disposed off.
