THIS PETITION COMING ON FOR ORDERS THIS DAY, B.S.PATIL J, MADE THE FOLLOWING:-
ORDER 1. This writ petition is filed by Sri B.Revanna – father of Supritha M.R., seeking a writ of habeas corpus directing respondents – State, Commissioner of Police, Bengaluru and Inspector of Police, Devanahalli Police Station, Bengaluru Rural District, to produce his daughter before this Court.
2. According to petitioner, Supritha M.R. has been missing since 15.01.2017 and that although he had lodged a complaint with Devanahalli Police Station on 16.01.2017 which was registered in Crime No.5/2007, the missing girl was not traced by the concerned police and therefore, petitioner was constrained to present this petition.
3. On 22.02.2017 after hearing the petitioner, we directed the learned Additional Government Advocate to take notice for respondents and secure information regarding the missing girl - Supritha.
4. Today, 3rd respondent - Police have produced Supritha M.R. They have also produced one Manjunath G. S/o.
Gurumurthy. On enquiry from Supritha, she states before the Court that she is aged 23 years and has completed her graduation (B.A) and has been voluntarily staying with Sri Manjunath. In fact, it is stated by her that both of them have got married on 05.02.2017 at Mulbagal. Sri Manjunath who is present before the Court also states that he is in love with Supritha and has married her and is willing to reside with her. Petitioner - Revanna is also present before this Court.
5. We are satisfied that Supritha being aged about 23 years and being a graduate has voluntarily chosen to go with Manjunath and she has not been illegally detained by him and therefore, question of proceeding further in this matter does not arise.
6. Hence, this writ petition is dismissed.
