Order:
This Civil Revision Petition arises out of Order, dated 05.06.2014, in EP.No.304 of 2009 in OS.No.88 of 1999 on the file of the Court of the learned Principal Senior Civil Judge, Ranga Reddy District, whereby she has ordered arrest and detention of the petitioners in civil prison for non- payment of the EP amount.
This Court, while ordering notice to the respondent, by Order, dated 14-08-2014, granted stay of arrest of the petitioners subject to the latter depositing 50% of the EP amount within four weeks therefrom.
At the hearing, learned Counsel for both the parties submitted that the said conditional order has been complied with.
Mr.MWR.Jayakar, learned Counsel for the petitioners, submitted that his clients have limited means to pay and that if reasonable time is granted to them, they will pay the balance EP amount.
Mr.Koneti Raja Reddy, learned Counsel for the respondent, submitted that the petitioners may be granted four months’ time for payment of the balance EP amount.
Having regard to the facts and circumstances of the case, the petitioners are permitted to pay the balance EP amount within four months from today. It is needless to mention that as and when the petitioners deposit the said amount, the respondent is entitled to withdraw the same without furnishing any security. If the petitioners fail to deposit the balance EP amount within the above stipulated time, the order under revision will stand revived.
Subject to the above directions, the Civil Revision Petition is disposed of.
As a sequel, CRPMP.No.3465 of 2014, filed by the petitioners for interim relief, is disposed of.
