THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 36923 of 2014 ORDER: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) Counter affidavit has been filed wherein it is stated that the police have not detained the alleged detenue. In fact, she is residing with her parents. She is a major and is before us.
When we find there is no police detention and the alleged detenue is residing with her parents, we close this matter.
It is submitted by the learned counsel for the petitioner that the alleged detenue has run away from the marital obligation and she has to come back to his client to discharge her marital obligation and to resume conjugal life. We are of the view that this cannot be decided by this Court. So we give liberty to the petitioner to approach the appropriate forum. However, the personal allegations made against the petitioner in the complaint are not admitted by the learned counsel for the petitioner. No order as to costs.
