ORDER:
This writ petition is filed for the following substantive relief: “…to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the proceedings in Ref.No.B/5121/2014, dated 18-08-2014 issued by respondent No.3 suspending the petitioner Fair Price Shop authorization as Fair Price Shop Dealer, Shop No.6, Badripalli Village, Chapadu Mandal, Y.S.R. District, as arbitrary, illegal, colourable exercise of power, contrary to the provisions of the AP State Public Distribution System (Control) Order, 2008 and violative of the fundamental rights guaranteed to the petitioner under Articles 14, 19 & 21 of the Constitution of India and consequently set aside the same and pass such other order or orders as are deemed fit and proper in the circumstances of the case.”
After arguing the case, Mr. V.R. Reddy Kovvuri, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to file a fresh writ petition with proper pleadings.
The writ petition is accordingly dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.38671 of 2014 shall stand disposed of as infructuous.
