Order:
This Contempt Case is filed alleging willful disobedience of Order, dated 01-11-2013, in WP.No.12661 of 2011, by the respondents.
This Court, on a prima facie consideration of the Contempt Case, expressed its displeasure at the way the respondents have acted in breach of the order of this Court. By Order, dated 27-06-2014, this Court has placed on record the submission of the learned Assistant Government Pleader for Revenue (Andhra Area) that respondent No.1 will take the remedial measures by initiating appropriate proceedings against the subordinate concerned, withdrawing the proceeding in Roc. No. E6/5710/2013, dated 12-01-2014, and removing the compound wall, which was, allegedly, constructed in violation of the order of this Court.
Respondent No.1 has since filed additional counter-affidavit wherein he has stated that he has taken all the three remedial measures referred to above. Along with the additional Counter-affidavit, respondent No.1 has filed the proceeding bearing ROC.No.E6/5710/2013, dated 28-06-2014, wherein he has withdrawn his earlier proceeding, dated 12-01- 2014, sanctioning construction of compound wall around Ac.0-85 cents of land in Survey No.1/1 of C.Ramapuram Village of Ramachandrapuram Mandal. Respondent No.1 has also filed a copy of charge memo, dated 01-07-2014, issued to respondent No.2. Respondent No.1 has mentioned in his additional affidavit that no compound wall was constructed around the subject land and that by the time, this Court has passed the order of status quo in the Writ Petition, pits were already dug.
The learned Counsel for the petitioner has stated that his client is satisfied with the steps taken by respondent No.1 to undo the damage caused to his client.
In the light of the above facts, this Court is of the opinion that respondent No.1 has purged the contempt if any. Therefore, the Contempt Case is closed.
