THIS PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R First petitioner is the husband of respondent No.2 Smt.K.B.Vinutha. Respondent No.2 has filed complaint against the first petitioner-husband and his family members on 20.07.2016, pursuant to the alleged incident on 14.05.2015 for the offences punishable under Sections 498A and 34 of IPC and under Sections 3 and 4 of the Dowry Prohibition Act. The petitioners have questioned the validity of chargesheet dated 25.02.2017 filed by Mahila Police Station, Mysore- respondent No.1 in C.C.No.1122/2017.
2. During pendency of the present petition, parties have entered into a settlement. The parties and their respective Counsels are present before the Court.
3. A joint memo dated 15.10.2019 is presented.
Petitioner No.1 is paying a sum of Rs.6,50,000/- (Rupees six lakhs fifty thousand only) by issuance of Demand Drafts dated 16.08.2019 drawn on HDFC Bank for sums of Rs.2,00,000/-, Rs.1,50,000/-, Rs.1,50,000/- and Rs.1,50,000/- respectively and the respondent No.2-Smt.K.B.Vinutha, has acknowledged the receipt of the said Demand Drafts. Consequently, charge sheet dated 25.02.2017 issued under C.C.No.1122/2017 is quashed.
Accordingly, petition stands allowed in terms of the joint memo.
