JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO. 18704 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned standing counsel appearing for the respondent.
This writ petition is filed seeking a writ of mandamus, declaring the inaction of the respondent in not considering the representation dated 28-06-2014 as illegal, arbitrary, violative of Articles 14 and 21 of the Constitution of India, besides violative of principles of natural justice and consequently direct the respondent to consider the representation dated 28-6-2014.
The petitioner is the mother of the deceased employee B.Srinivas who worked as senior chargeman (Operations) in respondent organization and he died while in service. It is submitted by the petitioner that she is totally depending on her son and her daughter-in-law who is the wife of the deceased and she is not looking after her properly.
From the contents of the affidavit filed in support of the writ petition and also the representation submitted by the petitioner to the respondent, it appears that there is a dispute between the petitioner and her daughter-in-law Padma regarding death benefits of the deceased Srinivas. In the aforesaid circumstances, the respondent is directed to dispose of the representation made by the petitioner within a period of two months from the date of receipt of copy of this order and pay the death benefits after resolving the dispute between the petitioner and her daughter-in-law as per rules.
Accordingly, the writ petition is disposed of. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
