. Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ, Order, or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 2nd respondent in issuing demand notices dt.12.12.2014 under Revenue Recovery At under Form-I to the petitioners as illegal, arbitrary, unconstitutional and consequently set aside the same by declaring that the petitioners are not defaulters or due any amounts to any persons.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri K.S. Murthy, Advocate for the Petitioners and G.P. for Revenue (AP) for Respondent Nos. 1 to 3, the Court made the following ORDER:
A request is made at 10-30 am today to adjourn W.P.No.545 of 2014 by the learned counsel appearing for the petitioner therein, but, that request was not acceded to as the said case is now connected with the present writ petition (W.P.No.39218 of 2014). But, now when both the matters are taken up for consideration, there is no representation on behalf of the petitioner in W.P.No.542 of 2014.
Registry is directed to list this matter along with W.P.No.542 of 2014 on 29-12-2014 in the Motion List.
However, in the mean time, the Tahsildar, Kankipadu Mandal, Krishna District, shall not take any coercive measures against the petitioner herein.
