However, the demand notice, which is required to be served individually to the petitioner assessee, was not served earlier and the same was served yesterday only. A speaking order thereof was also not communicated meaningfully, but the same has been served on the learned counsel for the petitioner in Court today only.
In view of the aforesaid factual position, we direct the respondent -Municipal Corporation to proceed further in the matter pursuant to the demand notice after a period of fortnight from date. In the meanwhile, it will be open for the petitioner to take steps in accordance with law as may be advised.
With the above observations, without deciding on merits of the case, the writ petition is disposed of. There will be no order as to costs.
Consequently, pending miscellaneous petitions, if any, shall stand closed.
