JUDGMENT / ORDER

ORDER:
This writ petition is filed for the following substantive relief: “…to issue a Writ, Order or Direction, more particularly a Writ of Mandamus declaring the orders passed by the 3rd respondent in cancellation of authorization of petitioner’s fair price shop No.27, situated at Chinnaramapuram, Chandragiri Mandal, Chittoor District, vide proceedings Roc.K/5555/2013, dated 25.8.2014 without issuing any notice to him and without following any procedure contemplated under law is nothing but illegal, arbitrary, unjust, contrary to the provisions of the Essential Commodities Act, 1955, and violation of principles of natural justice and set aside the orders passed by the 3rd respondent dated 25.8.2014 and consequently direct the respondents to allow the petitioner to run the fair price shop No.27 and to supply the essential commodities to the petitioner fair price shop in the interest of justice and pass such other order or orders as are deemed fit and proper in the circumstances of the case.”
After arguing the case, Ms. M. Hemalatha, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to her client to file a fresh writ petition with proper pleadings and relief.
The writ petition is accordingly dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.38699 of 2014 shall stand disposed of as infructuous.
