THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R The petitioner is before this Court seeking issue of mandamus or such other direction to respondent No.1 not to take physical possession of the petition schedule property.
2. The petitioner claims to be a tenant in respect of the premises regarding which respondent No.1-Bank has initiated action under the SARFAESI Act. As seen from the documents produced along with the objection statement of the respondents, respondent No.2 has already approached the Debts Recovery Tribunal in I.R.No.3949/206. In addition, in view of the amendment to Section 17 through sub-section 4-A, the petitioner who claims to be a tenant in respect of the premises is also provided the remedy of appeal.
In that view, reserving such liberty to the petitioner, the petition stands disposed of.
