HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION Nos.27539 and 27547 OF 2014 COMMON ORDER:
Petitioners claim to have purchased the different extents of land in R.S.Nos.130-3 and 129 of Chintampally village, Chintalapudi Mandal, West Godavari District, under registered sale deeds. Petitioners claim to be in possession and enjoyment of the said lands ever since from the date of purchase. The 2nd respondent issued pattadar pass books and title deeds in their favour and when they intend to dispose of the property, approached the Sub-Registrar, Chintalapudi, West Godavari District (4th respondent), the 4th respondent informed the petitioners that as per the records available with the registering authority, the lands are shown as Government land with ‘dots’ in R.S.R. Aggrieved thereby, these writ petitions are instituted.
2. The averments do not disclose presentation of the documents before the Sub- Registrar or a request made in writing for the purpose of provision of market value. It is only an averment that when a request is made, the Sub-Registrar orally informed that ‘dots’ are shown in the revenue records. Except this assertion, there is no other material in support of the said statement.
3. Having regard to the same, without expressing any opinion on merits, these writ petitions are disposed of, giving liberty to the petitioners to submit an application in writing to the Sub-Registrar, Chintalapudi, or to present deed of conveyance on the said properties and as and when such application/deed of conveyance is received by the Sub-Registrar, the same shall be processed in accordance with the Indian Registration Act, 1908 and Indian Stamp Act, 1899 and if the Sub-Registrar is not agreeable with the request of the petitioners, he shall communicate the reason to the petitioners within a period of three weeks from the date of receipt of such request/documents.
Miscellaneous petitions pending, if any, in these writ petitions shall stand closed. No costs.
