THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.31126 of 2014 ORDER :
On 21.10.2011 a notification was issued calling for applications for enlisting retail petroleum outlets by the Indian Oil Corporation Limited. The petitioner has applied for awarding dealership in Madhavaram Village, Kurnool District, which is shown at Sl.No.730 of the notification. Interview was conducted on 14.03.2012 and the petitioner was selected as No.1 in the merit panel. However, for a long time, there was no further correspondence. Petitioner having waited for a considerable time applied for information through application dated 27.02.2014. Vide letter dated 02.04.2014, the petitioner was informed that the reasons for not taking further steps in favour of the petitioner was that on the date of field inspection, the Bank balance was found to be less than the minimum requirement.
2. Aggrieved by the inordinate delay on allotment of petroleum retail outlet dealership and assigning the reason that the petitioner did not maintain the bank balance, as not valid, in law this writ petition is instituted.
3. Learned Counsel for the petitioner submits that the petitioner intends to submit a detailed representation to the 3rd respondent, ventilating his grievance and also offering explanation with reference to the bank balance.
4. Having regard to the said submission, the writ petition is disposed of without expressing any opinion on merits granting liberty to the petitioner to submit a detailed representation on the objection communicated to the petitioner in the letter dated 02.04.2014 and on receipt of such representation the competent authority shall consider the same and pass appropriate orders as warranted by law within a period of three (3) weeks from the date of receipt of such representation and communicate the decision to the petitioner. If the petitioner is aggrieved by the adverse decision, it is open for him to challenge the same in appropriate proceedings. There shall be no order as to costs.
5. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
