Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondent police to call for the entire records pending on the file of the 1st respondent/complainant in Crime No.260 of 2013 and quash the same.
2. It is the case of the petitioner that on the basis of the complaint given by one Dr.R.Selvakumar, a case was registered in Crime No. 260 of 2013 on 20.06.2013. Though the said complaint was registered on 20.06.2013, thereafter, there is no progress in the investigation and till date, final report was not filed. Hence, the present petition.
3. Today, when the matter was taken up for consideration, on instructions, learned Additional Public Prosecutor submitted that in Crime No.260 of 2013, investigation was completed and the matter was closed as 'mistake of fact' and RCS notice was also served on the petitioners.
4. In view of the said submission made by the learned Additional Public Prosecutor, I am of the opinion that nothing survives for adjudication in this matter. Hence, recording the said submission made by the learned Additional Public Prosecutor, the present Criminal Original Petition is closed. Consequently, connected miscellaneous petition is also closed.
