A preliminary objection has been raised by Sri Krishna Mohan Asthana, who has accepted notice on behalf of the respondent- Bank that earlier also the petitioners approached this Court by filing Writ Petition No. 5439 of 2018, which was ultimately dismissed vide order dated 10.02.2016 as withdrawn on their own request on the basis of statement that petitioners intend to approach the respondent-Bank for making the payment. The same relief has been claimed in this writ petition.
The instant writ petition being the second writ petition for the same cause of action is not maintainable and is not liable to be entertained and accordingly stands dismissed.
