HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 21548 of 2004 ORDER:
This writ petition was filed challenging the proceedings dated 09.09.2004 issued by the District Collector, Nellore.
Perusal of the impugned proceedings demonstrates that the said proceedings are in the nature of a show cause notice calling upon the petitioners to attend an enquiry regarding their community claim. It is a settled position of law that a writ petition would be maintainable against a show cause notice only on limited grounds. Such grounds have neither been pleaded nor established in the present case. Further, no interim order was granted by this court interdicting the proceedings pursuant to the impugned show cause notice.
The writ petition is accordingly dismissed. In the event, the proceedings have not been concluded pursuant to the impugned show cause notice owing to the pendency of this writ petition, the District Collector, Nellore, shall proceed and complete the same expeditiously after following the due procedure.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
