ORDER:
This writ petition is filed for a Mandamus to declare that the petitioner is entitled to supply of electricity to service connection No.5522200074047 pertaining to the premises bearing D.No.1-64, comprising 203.2 square yards, in Sy.No.240/4P/3 of Tiruchanur Village, Tirupathi Rural Mandal.
At the hearing, there is no representation for the petitioner.
This Court has initially granted an interim direction on 13.08.2014. However, the said interim order was vacated, by order dated 03.09.2014, on the submission made by the learned counsel for respondents 4 to 6 that O.S.No.67 of 2008 filed by respondents 4 to 6 against the petitioner for permanent injunction was decreed on 29.04.2014 and that no order of stay of the said decree was granted.
Inasmuch as the petitioner has suffered a decree for injunction, she is not entitled for issue of Mandamus for a direction to the public utility to supply power.
Therefore, the writ petition is dismissed, with liberty to the petitioner to avail appropriate remedy in the event the decree for injunction granted against her is reversed in appeal.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.28495 of 2014 shall stand disposed of as infructuous.
