JUDGMENT / ORDER

The writ petition is filed by the petitioner to issue a writ of Certiorari, calling for the records relating to the impugned order in IMU/EST/STAFF/2013/964, dated 05.08.2013 on the file of the first respondent and quash the same.
2. After elaborate arguments advanced by both sides, the matter was reserved for judgment on 22.11.2017.
3. At the instance of the learned counsel appearing for the writ petitioner, this matter is listed under the caption “for clarification” today.
4. The learned counsel appearing for the petitioner prayed this Court that the writ petitioner is agreed the impugned order dated 05.08.2013 passed by the 1st respondent except the allegations set out in the impugned order in respect of 3 lines in Para-4 of the impugned order dated 05.08.2013 since she already joined her parent department as per impugned order dated 05.08.2013 and therefore, the writ petition may be dismissed by deleting the 3 lines set out in para-4 of the impugned order dated 05.08.2013.
5. I also heard the learned counsel appearing for the respondents and he also agreed that the 1st three lines in para-4 of of the impugned order dated 05.08.2013 may be deleted and remaining order in respect of repatriating the petitioner to her parent department may be continued.
6. Therefore, I am of the absolute view that in respect of the allegations alleged to be committed by the petitioner viz., B.Chitra, which has been set out in 3 lines in para-4 of the impugned order dated 05.08.2013 has to be deleted and accordingly the same is deleted. But the other portions of the order which is stated that the Executive Committee has directed the petitioner viz., Dr.B.Chitra, COE, IMU, be repatriated to her parent department with immediate effect is unaltered.
7. In view of the above, by deleting 3 lines in para-4 of the impugned order dated 05.08.2013 and without unaltering the other portions of para-4 of the impugned order will continued and the writ petition is liable to be dismissed.
8. Accordingly, this writ petition is dismissed.
