This writ petition is filed for a mandamus declaring the orders in Rc.No.997/2014/B, dated 21-07-2014 of the 2nd respondent suspending the petitioner’s authorisation of the Fair Price Shop No.14, of Palleguntha village, Gurazalla Mandal, Guntur District as illegal and arbitrary and for a consequential direction to set aside the impugned proceedings.

The case of the petitioner is that he is working as Fair Price shop dealer of Pallegunta village for the last 30 years without any complaint and has been distributing the essential commodities to the cardholders. While so, the 2nd respondent issued proceedings in Rc.No.997/2014/B, dated 21-07-2014 suspending the authorisation of the petitioner’s fair price shop on the ground of certain irregularities being committed by him basing on the report of the Deputy Tahsildar, Gurazala dated 17-07-2014. Challenging the said proceedings, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.

Learned counsel for the petitioner submits that on the same day i.e. on 21-07-2014 a show cause notice was issued to the petitioner as to why a disciplinary action should not be taken against him for the alleged irregularities, for which the petitioner submitted a detailed explanation stating the reasons for not distributing the sugar, but no orders are passed thereon. The respondent authorities neither passed any orders on the explanation nor revoked the suspension order.

Having regard to the facts and circumstances of the case and in view of fact that the petitioner submitted his explanation to the show cause notice dated 21-07-2014, the 2nd respondent is directed to pass appropriate orders on the explanation submitted by the petitioner in pursuance of the show cause notice, after affording a reasonable opportunity of hearing to the petitioner. Till such orders are passed, the petitioner shall be continued as fair price shop dealer.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
