Heard learned counsel for the parties.
The grievance of the petitioner is that his mother B. Laxmi Devi was beaten by some unknown persons and she died of the head injury on 12.12.2013 and he lodged a complaint on 23.1.2014 with the third respondent, but no case was registered nor any investigation was taken up. Alleging inaction on the part of the third respondent, the present writ petition is filed.
Learned Government Pleader for Home, on instructions, submits that on receipt of the complaint from the petitioner on 23.1.2014, a detailed enquiry was made, statements of family members of the petitioners and other witnesses were recorded and it was disclosed that the deceased sustained head injury accidentally and that no one was responsible for it and the petitioner was also informed of the same. The learned Government Pleader for Home further submits that the petitioner also made a representation to the District Legal Service Authority, Ananthapur and on its direction, the third respondent submitted a report stating that the deceased died due to accidental fall from the auto and that other allegations are false and baseless by duly enclosing therewith the enquiry report containing 22 pages.
It is evident from the above that the police has already conducted enquiry into the allegations of the petitioner made in the complaint and submitted a report to the District Legal Services Authority, Ananthapur. However, the petitioner disputes the same and alleges that even his statement was not recorded. In the circumstances, therefore, the petitioner is at liberty to examine the said report and if he is not still satisfied, it is open to him to make a fresh complaint to the third respondent who shall take appropriate steps in accordance with law. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
