This Writ Petition is filed questioning the seizure of the vehicle of the petitioner being Eicher Tractor bearing No.AP 15AP 4819 along with Trailor bearing No.AP 15AP 4820. The petitioner alleges that F.I.R.No.141 of 2014 was registered on the file of P.S.Kataram, Karimnagar District, which is also unjustified, and seeks release of the vehicle.
The instructions of the learned Government Pleader for Home show that crime was already investigated and a charge sheet was filed before the Court of the Judicial Magistrate of First Class, Manthani, on 02.12.2014. It is also stated that the records as well as the vehicle are deposited with the learned Magistrate on 25.11.2014.
In view of the above instructions, since the learned Magistrate is seized of the criminal case and the property involved in the criminal case, the petitioner is at liberty to approach the learned Magistrate for release of the vehicle by way of an application. If such an application is filed, the learned Magistrate would entertain the said application and pass appropriate orders thereon, expeditiously.
Subject to the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
