HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.25259 of 2014 ORDER:
The case of the petitioners is that when they presented the Deeds of Conveyance in respect of the lands to an extent of Ac. 2.00 cents in Survey No.252-1A, an extent of Ac. 2.00 cents in Survey No.86-3 of Kirikera Gramapolam Village, Hindupur Mandal, Anantapur District (1st petitioner and petitioners 6 to 9), an extent of Ac. 2.09 cents in Survey No.164-4, an extent of Ac. 0.64 cents in Survey No.439-1A of Hindupuram Gramapolam Village, Hindupur Mandal, Anantapur District (2nd and 3rd petitioners), an extent of Ac. 2.32 cents in Survey No.414-1 of Pulakunta Village, Lepakshi Mandal, Anantapur District (4th petitioner) and an extent of Ac. 5.00 cents in Survey No.454-6 of Kethaganicheruvu Village, Somandepalli Mandal, Anantapur District (5th petitioner), before the Sub-Registrar, Hindupur, Anantapur District (7th respondent) for registration, he refused to receive the same. Hence this writ petition.
2. Learned counsel for the petitioners submits that irrespective of the status of the lands, the Sub-Registrar cannot refuse to receive the documents at the threshold. However, no evidence is shown as proof of presentation of documents for registration.
3. Having regard to the aforesaid submissions, this Writ Petition is disposed of granting liberty to the petitioners to present the Deeds of Conveyance before the Sub-Registrar, Hindupur, Anantapur District (7th respondent). As and when such Deeds of Conveyance is presented, the Sub-Registrar shall receive and process the same in accordance with the Registration Act, 1908, and the Indian Stamp Act, 1899. If the Sub-Registrar has valid reasons for refusing to register the Deeds of Conveyance, he shall pass orders under Section 71 of the Registration Act, 1908, and communicate the same to the petitioners within a period of two (2) weeks from the date of receipt of such documents. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
