Heard Sri P.Venkateshwer Rao, learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel for the respondents-Andhra Pradesh State Road Transport Corporation (the Corporation, for short).
2. This writ petition is filed seeking to declare the action of the respondents in terminating the petitioner a Contract Conductor is bad, arbitrary and illegal, and against to the Corporation Circulars by setting aside the Termination Order dated 02-02-2007 of the 3rd respondent herein and direct the respondents to reinstate the petitioner into service with continuity of service with all consequential service benefits such as regularisation etc.
3. The petitioner is a contract conductor in the respondents-Corporation. According to her, her services were terminated without conducting any enquiry on the ground of absenteeism.
4. Similar issue fell for consideration in W.P.No.9246 of 2014 wherein the termination orders were set aside on the ground that they were issued without initiating any enquiry.
5. The question involved in the present writ petition is squarely covered by the judgment dated 27-3-2014 in W.P.No.9246 of 2014. Therefore, the termination orders passed against the petitioner on 02-02-2007 are hereby set aside. There shall be a direction to the respondents- Corporation to reinstate the petitioner into service, however, without back wages and continuity of service. The respondents-Corporation, however, is at liberty to conduct enquiry into the absenteeism of the petitioner, if it so desires. This writ petition is disposed of accordingly. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
