ORDER:
This petition is filed to withdraw divorce O.P.No.762 of 2013 from Family Court, Ranga Reddy District at L.B.Nagar and transfer the same to Family Court, Guntur to be tried along with FCOP No.196/2014.
Petitioner is wife. According to her affidavit, filed in support of the petition, she filed FCOP.No.196/2014 before Family Court, Guntur seeking maintenance and she also filed a petition under Section 7 of Family Court Act for recovery of dowry amount and it is also pending before Family Court, Guntur and the respondent/husband filed O.P.No.762/2013 before Family Court, Ranga Reddy District at L.B.Nagar for divorce and all these matters have to be tried together. It is further stated that all the material witnesses in both the cases are one and the same and it will be convenient for both parties if the cases are tried at one place. For these reasons, she sought transfer of O.P.No.762 of 2013 from Family Court, Ranga Reddy District at L.B.Nagar to Family Court, Guntur.
Respondent, in spite of service of notice, neither appeared in person nor through any Advocate.
Heard the arguments.
Considering the reasons stated in the affidavit that all the OPs filed by wife and husband are to be tried by one Court, O.P.No.762 of 2013 is withdrawn from the Family Court, Ranga Reddy District at L.B.Nagar and transferred to Family Court, Guntur to be tried along with FCOP No.196/2014 for disposal in accordance with law.
The Transfer Miscellaneous Petition is accordingly allowed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
