HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.21744 of 2014 ORDER:
Aggrieved by an order of confiscation, dated 05.05.2014, the petitioner preferred an appeal before the appellate authority on 23.06.2014. Since appeal is not disposed of, this writ petition is instituted.
2. Learned counsel for the petitioner submits that there is no justification for keeping the appeal pending for so long and on account of the delay in consideration of his appeal, serious prejudice is caused to the petitioner. His motor cycle is confiscated and if the motor cycle is not maintained properly, it would lose its value and road usability and, therefore, there is an eminent need for early disposal of appeal.
3. Having regard to the submissions made and without expressing any opinion on merits, the Deputy Commissioner of Prohibition and Excise, Khammam, Khammam District (3rd respondent) is directed to consider and dispose of the appeal filed by the petitioner against the orders of confiscation, dated 05.05.2014, as expeditiously as possible, preferably within a period of two (2) weeks from the date of receipt of a copy of this order.
4. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
