(Ref: Criminal Misc. Delay Condonation Application No.01 of 2019) Shri Anil Kumar, Advocate has filed his power today on behalf of opposite party no.2, which is taken on record.
Heard learned counsel for the revisionist, learned counsel for opposite party no.2 and learned A.G.A. Perused the record.
Ground shown is sufficient.
Delay condonation application is allowed and the delay in filing the revision is condoned.
(Order on revision) This criminal revision has been preferred against the judgement and order dated 29.05.2019 passed by learned Additional Sessions Judge/Fast Track Court No.2, Shahjahanpur in Criminal Case No.162 of 2013 (Smt. Yasmeen vs. Azmat Ali) u/s 125 Cr.P.C., P.S.-Sadar Bazar, District- Shahjahanpur whereby opposite party no.2 has been awarded Rs.7000/- per month as maintenance from the date of order.
Heard learned counsel for the revisionist, learned counsel for opposite party no.2 and learned A.G.A. Perused the record.
Counsel for the revisionist has not been able to point out any such illegality, impropriety or incorrectness in the impugned order which may persuade this Court to interfere in the same. Rs.7000/- per month has been fixed as maintenance amount which cannot be said to be either excessive or disproportionate in the present days of high price rise. Impugned order reflects judicial application of mind. The evidence and circumstances were well discussed in the impugned order by the court below. This Court does not see any such element of perversity which may persuade this court to make any interference in the impugned order. There is no good reason to take a different view in the matter.
The present revision, therefore, stands dismissed.
