Heard Mr.Zalak Pipalia, learned advocate for the petitioner. It is submitted by him that by judgment and decree dated 25.07.2007 passed by the Trial Court in Regular Civil Suit No.125/1996, the suit of the petitioner has been decreed and it has been held that the petitioner has been allotted land bearing Survey No.57 and not Revenue Survey No.60, which has been written by mistake. This aspect has been brought to the notice of the Additional Secretary (Appeals), Revenue Department, during the pendency of the Revision Application. However, the Additional Secretary has totally ignored the judgment and decree passed by the Trial Court and has rejected the Revision Application of the petitioner on the ground that the lease for Revenue Survey No.60 has expired in the year 1997.
Issue Notice returnable on 26.03.2012.
Status-quo, as it exits today, qua the land in question, shall be maintained till then.
